Plastic Packaging

Plastic packaging material is made by using plastics for protecting, preserving, storing and transporting of products in a variety of ways.
Under plastic packaging, 4 types of entities have been categorized as obligated:

1. Producer: who is producing plastic packaging in India
2. Importer: One who is importing plastic packaging or products packed in plastic packaging in India.
3. Brand Owner: One who is finally introducing the plastic packaging in India under its own brand name or trademark.
4. Plastic Waste Processors: Recyclers of plastic packaging, co-processors, waste to energy plants or road construction.

PLEASE REMEMBER: In India, you must register on CPCB’s EPR Plastic Portal in order to do business and deal with only such companies who are already registered on CPCB’s EPR Plastic Portal.

E-waste

Any electrical or electronic equipment discarded as waste.
In India, 96 items have been identified under 6 broad categories of It & Telecommunication Equipment, Consumer Electrical & Electronics and Photovoltaic Panels, Large & Small Electrical & Electronic Equipment, Electrical & Electronic Tools, Toys, Leisure & Sports Equipment, Medical Devices.

Under E-waste, only Producer with broad functions as below are required to fulfil EPR obligations:

One who sells the Electrical or Electronic Equipment under its own brand name:
– Manufactures & offers to sell;
– Assembles & offers to sell;
– Imports & offer to sell;
– Who imports EEE.

PLEASE REMEMBER: In India, you must register on CPCB’s Centralized Online Portal in order to do business and deal with only such companies who are already registered on CPCB’s Centralized Online Portal.

Waste Tyre

Any tyre, including tubes and flaps that is no longer mounted on a vehicle and is no longer used for its intended purpose.
Under Waste Tyre, only Producer with broad functions as below are required to fulfil EPR obligations:

One who sells the tyres under its own brand name:

– Manufactures & sells new tyres domestically;
– Sells new tyres manufactured by another manufacturer/supplier;
– Imports & offer to sell;
– Imports vehicle fitted with new tyres;
– Automobile manufacturers who import new tyres for use in new vehicles and sells domestically;
– Imports waste tyres.

Battery Waste

Waste batteries include:
– Used/ End of life batteries which may or may not be hazardous in nature;
– Pre-consumer off-spec batteries
– Battery whose date of use is expired
– Battery which have been discarded by the user

Under battery waste, only Producer with broad functions as below are required to fulfil EPR obligations:

One who sells the batteries under its own brand name:
– Manufactures & sells batteries (new or refurbished);
– Selling battery (new or refurbished) produced by other manufacturer/ supplier included in Producer’s equipment.
– Imports batteries or equipment containing batteries;

EPR is a policy framework implemented under various categories of wastes in India to make Producers liable for the quantity of products introduced by them in the market in order to properly reuse/ recycle them in an environmental sound manner. If you’re a person or entity who is introducing either plastic packaging, electrical and electronic equipment, tyre or batteries in the Indian market then after the end-of-life of these products you will be obligated for their environmentally friendly management (reuse/ recycle)
